just need an opinion if this bimmer is good to buy

There's so much unknown to take into account.
Who did the work...are they competent?
Modified cars (no matter what make/model) are always something I shy away from because I don't want to deal with someone else's mistakes. I'd rather start with a bone stock model and modify it (or pay a professional) to my liking.

My .02 (for what it's worth as a newbie to BMW)...I'd avoid a highly modified car unless I knew the person selling it, who did the work, and I trusted that it was done properly. From a stranger...no way!!

Is that what he told you...or did he show you receipts?
Could you contact the people that did the work and ask about the details?

If I were considering this car (and it does sound bad ass)...I would HAVE to talk to the people that did the work to verify they actually did it, and I would want an independent BMW specialist that performs similar high-performance modifications to inspect the work on the car.

If all this stuff checked out...then (and only then) would I consider making an offer.

I would pass. If someone really knows what he's doing, I don't see why he bought a 323 then put a supercharge on it. The way I see, someone bought the car thinking it will be a really fast car then realized it's not and try to addmore HP. There is too much details to check if everything will run fine for a while. It's a big risk IMO.

If it was a real enthusiastic, he would bought a 330 or M3 in the first place.

He does have recipts and dyno sheet at 312 hp. and my brother is a mechanic he will be coming with me tomorrow to see the car he used to be a head mechanic at Mercedes Benz so he knows German cars he knows a lot lol. You see I just wanna know if it will give any problems for the next 3 years my friend is trying to tell me oh the motors gunna blow or the trans will blow becaude of the stress of the supercharger. I just wish I could know if it will have problems within about 50xxx miles if so what kind and how much money to fix.

I don't think any E46 (modified or not) will have 50k miles of flawless (no problems) driving.
Will you experience a catastrophic failure in 50k miles...nobody can guess that man. But you ARE more likely to experience major mechanical issues than a properly maintained E46 in original condition.

I think you really do know the answer to your question is...YES - this car is more risky than a well maintained original car. How much mileage you can get out of it...really it's a gamble, and the odds are stacked against you because no matter how perfectly this car was modified the addition of forced induction DOES add stress to major components. There's no getting around that.

Out of the 109k miles on the car -- how many are with the modifications? Did he just modify it, or has it been this way for 50k miles already?

I'm no expert but my 2 cents worth....

There really isn't any guarantee! High performance cars that have been modified have increased overall stress and the likelihood of something going wrong at any given moment. And I'm sure you will power this baby every opportunity you get, thus aforementioned may apply.

Follow as suggested earlier and if satisfied... make your decision from there.

Haha sorry man bimmers it is. And guys I wasn't able to look at the car today im going Monday but I found out more its his pleasure car not his DD so its real clean its the stock gear box with a stage 2 clutch so I figure as long as it has a good clutch that will take most of the abuse from the added power for the trans. I also found out from 3-4 k Rpms it puts out about 4 lbs of boost 5-6 k rpms it puts out about 6-8 lbs of boost and 6- redline it gets close to 11 lbs of boost. Does that sound good like the tranny will hold up on this bimmer for awhile granted I'm going to use it as a DD so I'm not going to beat on the car ill use the power but not abuse it.
