late oil change voids warranty?!?!

i brought my 2008 528xi, with 47k miles on it, to dealership to fix the engine ticking i have read so much about on these forums. The dealership agreed that that the tick was present. however, they found sludge in engine and claim it needs a new cylinder head. they also claim this is completely the result of the previous owner not changing the oil on time and therefor are not going to cover the repairs. the vehicle has had 3 oil changes in its 47k. I certainly plan to do it more often. All other maintenance is up to speed and the car runs great.
With all i have heard and read about valve lifters failing and engine sludge being present on vehicles that adhere to the maintenance guidelines, i am a very surprised by their stance on this.
Any thoughts on them voiding my warranty due to someone being late on a oil change?

Sounds sort of like B.S. to me - what do their records indicate? The reaon I am asking, depending on how the car was driven, you could easily have a 17,000 mile oil change interval based on I-drive. My oil was changed last at 32,000 and right now at 39,000 I still have another 8,000 miles to go.

Since they denied you warranty, I would ask them for proof based on BMWs internal system that shows that the previous owner did not change the oil on time. I would suspect that BMW's system logs messages such as 500 miles overdue.

It does seem to be kind of harsh - once you have all the facts talk to BMWNA.

This is B.S. I used to be a service adviser at a dealership, and I will tell you right now they cannot void your warranty because of lack of maintenance. Just make it pretty simple, call BMWNA, tell them your story and it will be fixed. If they give you a hard time have a lawyer call. Your car is still under warranty, therefor the dealer would have to prove that the failure was due to negligence. That would not be an easy task when the maintenance on the car is also covered under warranty.

My 2010 535I had it second oil change (per BMW) at about 32,000 miles. The next is estimated by my oil life indicator to be due at over 47,000 miles...
Sounds like BS

When you bought the car, was it a CPO car? If so, then my understanding is that in order for it to have qualified as a CPO car to begin with, that all the maintenance had to have been done on time and documented. If so, then your car is under warranty.

was this purchased from a dealer? If it was and the car was listed with "remainder of factory warranty" then it is BMW's problem since they had the info and they "lied"

Dude, this doesn't make any sense. I'm not going to debate weather or not overlooking your scheduled maintenance will void your warranty. However, my point is that the dealer can't make this claim as the previous owner could have easily changed his oil after every 7,500 and not reset the sensor. To the OP, you should be extremely confident that the dealer doesn't have a leg to stand on and that they without a doubt need to replace this for you under warranty. Unreal....
